Article 2 - Applicability

  1. These terms and conditions apply to every order placed on the Afternoon Stories website. These conditions can be sent on request.
  2. If the distance contract is concluded electronically, notwithstanding the previous paragraph and before the distance contract is concluded, the text of these general terms and conditions can be made available to the consumer electronically in such a way that the consumer can can be stored in a simple way on a durable data carrier. If this is not reasonably possible, before the distance contract is concluded, it will be indicated where the general terms and conditions can be read electronically and that they will be sent electronically or otherwise at the request of the consumer.
  3. The provisions of these terms and conditions can only be deviated from in writing, in which case the other provisions will remain in full force and effect.
  4. Afternoon Stories has the right to change the terms and conditions. If this change occurs after the conclusion of the agreement, our customer is authorized to dissolve the agreement.
  5. We cannot accept any liability for the consequences of text errors

 

Article 3 –The offer

  1. Afternoon Stories has the right to change the terms and conditions. If this change occurs after the conclusion of the agreement, our customer is authorized to dissolve the agreement.
  2. If an offer has a limited period of validity or is made subject to conditions, this will be expressly stated in the offer.
  3. The offer contains a complete and accurate description of the products, digital content and/or services offered. The description is sufficiently detailed to allow a proper assessment of the offer by the consumer. If Afternoon Stories uses images, these are a true representation of the products offered. Obvious mistakes or obvious errors in the offer are not binding after Afternoon Stories.
  4. Each offer contains such information that it is clear to the consumer what rights and obligations are attached to the acceptance of the offer.

 

Article 4 -The agreement

  1. Subject to the provisions of Article 3, the agreement is concluded at the moment of acceptance by the consumer of the offer and the fulfillment of the associated conditions.
  2. If the consumer has accepted the offer electronically, Afternoon Stories will immediately confirm receipt of acceptance of the offer electronically. As long as the receipt of this acceptance has not been confirmed by Afternoon Stories, the consumer can dissolve the agreement.
  3. An agreement is only concluded after acceptance of your order. Afternoon Stories is entitled to refuse orders or to attach certain conditions to the delivery, unless explicitly stated otherwise. If an order is not accepted, Afternoon Stories will inform you within 10 working days after receipt of the order without stating reasons.
  4. Afternoon Stories can inform itself within legal frameworks whether the consumer can meet his payment obligations, as well as all those facts and factors that are important for a responsible conclusion of the distance contract. If On the basis of this investigation Afternoon Stories has good reasons not to enter into the agreement, it is entitled to refuse an order or request with reasons, or to attach special conditions to the execution.

 

Article 5 – Right of withdrawal

  1. When purchasing products (with the exception of wallpaper!) the consumer has the option to dissolve the agreement without stating reasons during 14 days. This reflection period starts on the day after receipt of the product by the consumer.
  2. During the reflection period, the consumer will handle the product and the packaging with due care. If he makes use of his right of withdrawal, he has not used the product and will return the product with all accessories supplied and in the original condition and packaging to Afternoon Stories.
  3. The consumer informs by e-mail that he wants to return a product. Returns of delivered products can only take place after approval by Afternoon Stories. PLEASE NOTE: The consumer states in the subject of the e-mail the order number that was received by e-mail.
  4. The products are returned at your own expense.
  5. Afternoon Stories reserves the right to refuse returned items or not to credit the full amount if it is suspected that the item has been damaged by the customer.
  6. If the consumer has paid an amount, Afternoon Stories will refund this amount as soon as possible, but no later than 5 days after the return or withdrawal.

 

Article 6 –Compliance with the agreement and extra warranty

  1. Afternoon stories guarantees that the products comply with the agreement, the specifications stated in the offer, and the reasonable requirements of reliability and/or usability.
  2. The consumer has the obligation to examine upon delivery whether the products comply with the agreement. If this is not the case, the consumer must notify Afternoon Stories in writing and with reasons within 7 working days after delivery.
  3. If it is demonstrated that the products do not comply with the agreement, the products concerned will be replaced by new products. The costs for returning in this case are for Afternoon stories.

 

Article 7 –Delivery and execution

  1. Afternoon Stories will take the greatest possible care when receiving and executing orders for products.
  2. The place of delivery is the address that the consumer has made known to the Afternoon Stories.
  3. The specified delivery times are indicative. Exceeding any delivery term does not entitle you to compensation, nor the right to cancel your order or to dissolve the agreement, unless the exceeding of the delivery term is such that you cannot reasonably be expected to maintain the agreement. In that case you are entitled to cancel the order.
  4. The delivery time stated with the articles starts as soon as Afternoon Stories has received the payment from the customer.
  5. The risk of damage and/or loss of products rests with Afternoon Stories until the moment of delivery to the consumer, unless expressly agreed otherwise. The risk in respect of the products commences at the time of delivery to the consumer. The risk of any return of the items is for the customer.
  6. Afternoon Stories is allowed to deliver sold goods in parts. Afternoon Stories informs the consumer of the reason for partial delivery.

 

Article 8 –Payment

  1. The consumer has the obligation to immediately report inaccuracies in payment details provided or stated to Afternoon Stories.
  2. The consumer pays at the end of the electronic order by means of IDEAL. In consultation, the consumer can choose to make the payment himself by bank transfer. The order will never be shipped before the full amount has been received.
  3. All prices for the items offered include VAT and exclude shipping costs.

 

Article 9 –Complaints procedure

  1. Complaints about the implementation of the agreement must be submitted fully and clearly described to Afternoon Stories within a reasonable time of 7 days.
  2. Complaints submitted to Afternoon Stories will be answered within a period of 14 days from the date of receipt. If a complaint requires a foreseeable longer processing time, the entrepreneur will answer within the period of 14 days with a notification of receipt and an indication when the consumer can expect a more detailed answer.
  3. Afternoon Stories is in no way liable for possible damage to a wall or other items after, or as a result of, the use of Afternoon Stories products or their removal.
  4. In the event of a complaint, you must keep the original product so that we can review it if necessary. We may also ask you to take photos so that we can better assess the complaint.

Article 10 –Disputes

  1. Only Dutch law applies to agreements between Afternoon Stories and the consumer to which these general terms and conditions apply.
  2. A dispute will only be handled by the court if the consumer has first submitted his complaint to Afternoon Stories within a reasonable time.

 

Article 11 – Intellectual property

  1. Afternoon Stories has and retains all intellectual property rights that rest or can be established on the design.
  2. It is not allowed to make reproductions of Afternoon Stories designs without permission from Afternoon Stories.

 

Article 12 – Miscellaneous

  1. If one or more of the provisions of these terms and conditions or any other agreement with Afternoon Stories should conflict with any applicable legal provision, the relevant provision will lapse and will be replaced by a new legally permissible comparable to be determined by Afternoon Stories provision. Should this change occur after the conclusion of the agreement, our customer is authorized to dissolve the agreement.
  2. Afternoon Stories is authorized to use third parties for the execution of your order(s).
  3. The text of the general terms and conditions is always decisive for the explanation thereof.
